Terms Of Service

1. Acceptance & Definitions

 

These Terms of Service govern all commercial filmmaking, photography, and content production services provided by "aprcommercials" to the Client. By booking a shoot, paying a deposit, or signing a quotation, the Client accepts these terms in full.

 

2. Scope of Services

 

"aprcommercials" provides commercial film and short-form content services including pre-production, on-location filming, post-production editing, colour grading, sound design, and final delivery.

Specific deliverables, formats, durations, and timelines are set out in the project quotation issued to the Client prior to commencement.

 

3. Invoices, Bookings & Deposits

 

All invoices issued by "aprcommercials" are valid for 30 days from the date of issue unless stated otherwise in writing.

 

A shoot date, editing slot, or production booking is only confirmed once the required booking deposit has been received and cleared.

 

A 50% upfront booking deposit is required to secure the project. The remaining 50% balance must be paid before the shoot takes place.

 

No filming, production work, editing, or final delivery will take place until the full project balance has been paid.

 

For monthly retainer agreements, invoices are issued and payable monthly in advance. Production dates, shoot time, editing time, and delivery slots are only reserved once cleared funds have been received.

 

Late payment, failed payment, or non-payment may result in the shoot date, edit schedule, or delivery timeline being delayed or released.

 

 

4. Payment Terms

 

 

A 50% deposit is required to secure the project and confirm the shoot date.

 

The remaining 50% balance must be paid in full no later than the day before the shoot.

 

If payment has not been received before the shoot, "aprcommercials" may delay or cancel the booking until payment has cleared.

 

Any extra work, additional edits, extra deliverables, travel costs, location costs, or agreed add-ons will be invoiced separately and must be paid within 14 days of the invoice date.

 

Final videos, images, edits, raw footage, or project files will not be released until all outstanding payments have been received.

 

For ongoing monthly work, payment terms will be agreed separately in writing.

 

 

5. Deliverables & Revisions

 

 

The final deliverables for each project will be agreed before booking. This may include final videos, images, social media edits, website edits, or other agreed content formats.

 

Final videos are usually delivered as MP4 files in the agreed format, such as 9:16, 16:9, 1:1, 4K, or 1080p.

Each project includes one round of reasonable revisions unless agreed otherwise before booking.

Reasonable revisions include small changes such as text changes, minor timing adjustments, basic clip swaps, or small edit refinements.

 

Major changes, new creative direction, extra edits, additional versions, reshoots, or changes outside the original brief may be charged separately.

 

Raw footage, editable project files, timelines, working files, and unused footage are not included unless agreed and purchased separately.

 

6. Client Responsibilities

 

 

The Client is responsible for providing a clear brief before the project begins.

 

The Client must arrange access to the filming location and confirm that "aprcommercials" has permission to film there.

 

The Client is responsible for supplying any products, branding assets, logos, staff, models, vehicles, property access, or other items needed for the shoot.

 

The Client must make sure that any people, premises, products, vehicles, music, branding, or materials they provide are allowed to be used in the final commercial content.

 

If delays happen because access, permissions, products, people, or assets are not ready, this may affect the shoot, edit, or delivery schedule.

 

"aprcommercials" is not responsible for delays, extra costs, or unusable footage caused by missing access, missing permissions, incorrect information, unavailable talent, or incomplete materials supplied by the Client.

 

 

7. Unexpected Events

 

Sometimes a shoot may need to be delayed, changed, or rescheduled due to circumstances outside either parties control.

 

This may include severe weather, illness, unsafe filming conditions, transport issues, venue problems, equipment failure, public emergencies, or other unexpected events.

 

If this happens, "aprcommercials" will make reasonable efforts to rearrange the shoot for a suitable new date.

 

Any payments already made will usually be carried over to the rescheduled date, unless a different arrangement is agreed.

 

"aprcommercials"  is not responsible for delays caused by events that are outside reasonable control.

 

 

8. Liability 

 

"aprcommercials" will take reasonable care when carrying out all filming, editing, and production work.

Where applicable, "aprcommercials" will hold appropriate insurance for the services being provided.

 

"aprcommercials" is not responsible for delays, losses, or issues caused by incorrect information, missing permissions, unavailable locations, unavailable talent, unsafe conditions, or incomplete materials supplied by the Client.

 

"aprcommercials" is not responsible for the commercial performance of the final content, including sales, enquiries, views, engagement, revenue, brand growth, or advertising results.

 

"aprcommercials" ’ responsibility for any single project is limited to the amount paid by the Client for that project.

 

 

 

9. Cancellation

 

 

Either "aprcommercials" or the Client may cancel a project by giving written notice.

 

The 50% booking deposit is non-refundable once the shoot date has been confirmed, as this secures time in the schedule and may prevent other bookings from being accepted.

 

If the Client cancels after work has already started, the Client may still need to pay for any work already completed, time already spent, or agreed costs already arranged for the project.

 

This may include shoot preparation, planning, editing, travel, location costs, hired equipment, music, stock assets, or any other agreed project costs.

 

If "aprcommercials" needs to cancel due to illness, emergency, unsafe conditions, or circumstances outside reasonable control, the Client will be offered either a suitable new shoot date or a refund for any work that has not yet been completed.

 

If the Client chooses to reschedule, any payments already made will be transferred to the new agreed date.

 

10. Governing Law

 

These terms are governed by the laws of England and Wales.
