Copyright & Licensing

1. Ownership of Work

 

All footage, photographs, edits, project files, scripts, and creative materials produced by aprcommercials remain the intellectual property of aprcommercials until full payment of the project has been received and cleared.

 

Upon full payment, the Client is granted a perpetual usage licence as outlined in section 2. "aprcommercials" retains underlying copyright in all original creative work unless explicitly transferred in writing.

 

2. Licence Granted to the Client

 

Once the agreed project fee has been paid in full, the Client is granted a perpetual, non-exclusive, non-transferable, royalty-free licence to use the delivered final films, videos, images, edits, and approved content for the Client’s own business marketing and promotional purposes.

 

This licence allows the Client to use the final delivered content across their owned and controlled channels, including their website, social media accounts, paid digital advertising, email marketing, in-store displays, presentations, and trade events.

 

The Client may not sell, resell, redistribute, sublicense, transfer, assign, give away, upload to stock libraries, or otherwise commercially exploit the content as a standalone asset.

 

The content may not be used by, sold to, licensed to, or transferred to any unrelated third party, agency, brand, franchise, partner company, parent company, subsidiary, or separate commercial entity without "aprcommercials"’ prior written consent and a separate paid licence agreement.

 

All copyright and intellectual property rights in the content remain owned by APRCOMMERCIALS unless expressly transferred in writing.

 

3. Portfolio & Promotional Rights

 

Unless otherwise agreed in writing, aprcommercials retains the right to use stills, clips, and behind-the-scenes footage from any project for our own portfolio, social media, awards submissions, and case studies.

If a project is under embargo or contains sensitive material, the Client must notify us in writing before the shoot date and we will agree a release date together.

 

4. Music & Third-Party Assets

 

Where music is used in the delivered content, "aprcommercials" sources music from licensed music libraries such as Epidemic Sound or equivalent professional licensing platforms.

 

Music is licensed only for the specific project, platforms, usage, and end purpose agreed at the brief or proposal stage.

 

The Client does not receive ownership of the music, soundtrack, stems, sound effects, or any third-party audio assets.

 

Where Epidemic Sound or a similar subscription-based music library is used, the music licence is held through "aprcommercials" active account and applies only to the final approved content produced by "aprcommercials".

 

The Client may be required to provide live upload links, channel details, advertising links, or platform URLs so that "aprcommercials" can clear, safelist, or validate the content where required by the music provider.

 

The Client must not extract, reuse, remix, resell, redistribute, or use the music separately from the final delivered film.

 

Any use outside the originally agreed scope, including additional platforms, broadcast television, radio, cinema, video-on-demand, paid media not agreed in advance, third-party brand use, resale, sublicensing, or wider campaign usage, may require a separate music licence and additional fees.

 

Stock footage, fonts, templates, graphics, sound effects, plugins, or other third-party assets integrated into the final deliverables are licensed only for the agreed final use. The Client does not receive ownership of these third-party assets and may not reuse them separately from the completed content.

 

5. Talent, Privacy & Releases

 

The Client is responsible for ensuring that all individuals, staff, customers, models, actors, performers, contractors, or representatives featured in the content have been informed that filming is taking place and that the final content may be used for commercial, promotional, advertising, and marketing purposes.

 

Where individuals are clearly featured, identifiable, interviewed, directed, posed, speaking, performing, or central to the final content, the Client must ensure that appropriate consent, permissions, and/or model release forms have been obtained before filming or publication.

 

"aprcommercials" can supply standard model release forms where required. However, unless otherwise agreed in writing, responsibility for obtaining permissions from the Client’s staff, customers, guests, contractors, performers, or representatives remains with the Client.

 

If an individual raises a concern, objection, or withdrawal request before final delivery, "aprcommercials" and the Client will review the affected footage and, where reasonably required, remove, replace, blur, crop, or exclude that individual from the final content.

 

The Client is responsible for ensuring that filming on their premises complies with applicable privacy, data protection, employment, and safeguarding requirements.

 

6. Drone & Regulatory Compliance

 

Aerial filming may be available on selected projects where it can be carried out safely, legally, and with the correct permissions. Drone work will only be provided where the relevant CAA registration, insurance, landowner permissions, airspace checks, and operational requirements are in place.

 

Where filming takes place on private property, council land, public land, or in restricted airspace, the Client may be required to assist with confirming access permissions, location approvals, and landowner or site manager consent.
